A Golden Opportunity The Employee Retention Credit presents a golden opportunity for businesses to recover from the financial setbacks caused by government orders and the COVID-19 pandemic. Many businesses faced financial challenges during this period, and the government introduced multiple relief packages to help them recover. 

Although the ERC was initiated during the pandemic, businesses can still seek financial relief for up to 7 quarters in which their profits were affected. What’s more, the newly enacted IRS “Complex Qualifiers” Law allows businesses to access even more funds. 

Let’s delve into the process of calculating your ERC and how much your business can benefit. 

Determine If Your Business Qualifies

For both 2020 and 2021 your business qualifies if it was subject to government-mandated closures or adheres to the new “Complex Qualifiers” Law recently enacted by the IRS. 

If your business experienced partial or full suspension of hours during these quarters, you qualify for the ERC. Additionally, a decline in profits is a qualifying factor, but the criteria differ by year. 

Let’s break down the qualifications for each year in which the ERC applies to determine the quarters you’re eligible for, allowing for a more accurate calculation of potential benefits. 

Qualifications for 2020 

  • Your business must have experienced a revenue decline of 50% or more compared to the same quarter in 2019. 

Qualifications for 2021 

  • The criteria for 2021 changed, with a decline of 20% or more in revenue compared to the same quarter in 2019. 

Calculating the ERC for Qualifying Quarters 

Once you identify the qualifying quarters, you can calculate your ERC based on each year. 

Calculating for 2020 

  • For qualifying quarters in 2020, you can claim 50% of up to $10,000 in wages, with a maximum limit of $5,000 per employee for the entire year. Businesses with fewer than 100 employees can claim all wages, while those with over 100 employees can only claim wages paid when the employee wasn’t working. 

Calculating for 2021

  • In 2021, the parameters remain the same, except the rate has increased from 50% to 70%. This means the limit has been raised to $7,000 per employee. The employee limit has also increased from 100 to 500, following the same guidelines.
